1. Our Commitment to Intellectual Property Rights
BuildSwap respects intellectual property rights and expects all users of the Platform to do the same. This Copyright and Intellectual Property Policy explains how we handle reports of alleged copyright infringement and other intellectual property complaints on the BuildSwap marketplace platform.
2. User Responsibility
When you create a listing or submit any content to the Platform, you represent and warrant that:
- You own all rights to the business, content, and materials you are listing, or you have the necessary rights and permissions to list and sell them.
- Your listing does not infringe upon any copyright, trademark, trade secret, patent, or other intellectual property right of any third party.
- You have the legal authority to transfer, license, or sell the business and its associated assets.
Sellers are solely responsible for ensuring that their listings comply with all applicable intellectual property laws.
3. Reporting Copyright or IP Infringement
If you believe that content on the BuildSwap Platform infringes your copyright or other intellectual property rights, please submit a complaint to us by email.

Subject line: `IP Complaint`
Your complaint should include the following information:
1. Your contact information: Your full name, email address, and relationship to the rights holder (for example, owner or authorized agent). 2. Description of the work: A description of the copyrighted work or intellectual property right you claim has been infringed. 3. Location of the infringing content: The URL or title of the listing or content on BuildSwap that you believe infringes your rights. 4. Statement of good faith: A statement that you have a good faith belief that the use of the material is not authorized by the rights holder, their agent, or applicable law. 5. Statement of accuracy: A statement that the information in your complaint is accurate and, under penalty of perjury, that you are the rights holder or are authorized to act on their behalf. 6. Signature: Your physical or electronic signature.
4. Our Review Process
Upon receiving a complaint, BuildSwap will:
1. Acknowledge receipt of your complaint within 2 business days. 2. Review the complaint to determine whether the reported content appears to infringe the claimed rights. 3. Take appropriate action, which may include removing or disabling access to the reported content and notifying the content uploader. 4. Notify you of the outcome within a reasonable timeframe.
We review all complaints on a case-by-case basis. Submitting a complaint does not guarantee that content will be removed. We will make reasonable efforts to act on valid complaints promptly.
5. Counter-Notices
If you believe content was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notice by email to legal@buildswap.online with the subject line `IP Counter-Notice`.
Your counter-notice should include:
1. Your full name and contact information. 2. Identification of the content that was removed and where it appeared. 3. A statement under penalty of perjury that you have a good faith belief that the content was removed as a result of mistake or misidentification. 4. Your physical or electronic signature.
We will review counter-notices and may reinstate removed content at our discretion if we determine the original complaint was in error.
6. Repeat Infringers
BuildSwap reserves the right to terminate the accounts of users who are found to repeatedly infringe the intellectual property rights of others. We will evaluate each situation and take appropriate action in our sole discretion.
7. Trademark Complaints
If you believe your trademark is being infringed by a listing or user on BuildSwap, please follow the same reporting process described in Section 3, substituting details relevant to your trademark rights.
8. No Legal Advice
Nothing in this policy constitutes legal advice. If you are unsure whether content infringes your rights, we recommend consulting a qualified intellectual property attorney before submitting a complaint.
9. Changes to This Policy
We may update this Copyright and Intellectual Property Policy from time to time. Material changes will be reflected by updating the "Last Updated" date on this page.
